Please read these Terms of Use ("Terms") carefully. They are a binding agreement between you and Tilek Koszhanov ("we", "us", "our"), the developer of the Echo voice-assistant application for iPhone and Apple Watch (the "App"). By downloading, installing or using the App, you accept these Terms and Apple's Licensed Application End User License Agreement. If you do not agree, do not use the App.
Echo is a voice assistant: you tap to record a short spoken command, and Echo uses artificial intelligence to transcribe it, understand your intent, and create or update a reminder or calendar event after you confirm it ("AI Features"). When you record a command, the audio you choose to capture is sent from your device to our processing service and then to a third-party AI provider, which returns a transcription and a structured request. Echo only records when you start a capture — there is no background listening or wake word. See our Privacy Policy for full details of this data flow.
AI Features generate text and structured requests automatically using statistical models. They may mis-hear your words, misinterpret your intent, pick the wrong date or time, create a duplicate, update the wrong item, or otherwise produce inaccurate or incomplete results. Echo always shows a confirmation card before creating or changing anything, and you are solely responsible for reviewing that card and deciding whether to confirm. A reminder created without a time will not notify you. You must not rely on Echo for anything safety-, health-, financial- or time-critical (for example medication, medical appointments, legal deadlines, or emergencies); always verify the entry in Apple's Reminders or Calendar. The App does not provide professional advice. We are not responsible for any missed reminder, incorrect event, or any decision or action you take based on Echo's output.
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) and legally able to enter into these Terms. The App is not directed to children under that age.
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App on Apple-branded devices you own or control, in accordance with these Terms, the App Store Terms of Service and the Apple Standard EULA referenced in Section 12. We retain all rights, title and interest in and to the App, including all intellectual property. You may not copy, modify, reverse engineer, resell, sublicense or create derivative works of the App, except to the extent this restriction is prohibited by applicable law.
As between you and us, you retain ownership of the voice commands you record and the text derived from them ("Input") and the reminders or events you choose to create ("Output"). You represent that you have the right to submit your Input and that doing so does not violate any law or third-party right. You grant us the limited right to process your Input solely to provide the AI Features to you, as described in the Privacy Policy.
You agree not to use the App to: (a) create, process or distribute content that is unlawful, infringing, defamatory, harassing, hateful, sexually exploitative, or that promotes violence or harm; (b) violate the rights of others or any applicable law, including recording another person's voice without any consent required by law; (c) attempt to disrupt, overload, probe, reverse engineer or gain unauthorised access to the App, our processing service, or the AI provider; (d) circumvent usage limits, security or subscription controls; or (e) submit other people's personal or confidential data without authority. We may suspend or terminate access if you breach this Section.
AI Features are delivered through a third-party provider (currently OpenAI) and our hosting provider (Vercel), and subscriptions are managed via Apple and RevenueCat. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for the acts, omissions, availability or content of third-party services, and the active provider may change without notice.
The App and AI Features are provided on an "as available" basis and depend on a network connection and the availability of third-party services. We may modify, suspend, limit (including by applying fair-use or rate limits) or discontinue the App or any feature at any time, with or without notice, without liability to you, except as required by law.
To the maximum extent permitted by applicable law, the App is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, that speech will be transcribed correctly, that intent will be understood correctly, or that any reminder or event will be created, scheduled or delivered accurately or on time. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
To the maximum extent permitted by applicable law: (a) we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill or business, or for any missed, late, incorrect or duplicated reminder or event, arising out of or relating to the App or its output, even if advised of the possibility; and (b) our total aggregate liability for all claims relating to the App will not exceed the greater of (i) the amount you paid us (via Apple) for the App in the 12 months before the event giving rise to the claim, or (ii) USD 50.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud, or any mandatory consumer-protection rights you have in your country of residence.
This App is licensed, not sold, to you. Your licence is also subject to Apple's Licensed Application End User License Agreement (the "Apple Standard EULA"), available at apple.com/legal/internet-services/itunes/dev/stdeula. To the extent of any conflict, the more protective term in our favour permitted by law applies. The following acknowledgements are required:
To the extent permitted by law, you agree to indemnify and hold us harmless from any claims, damages, liabilities and reasonable expenses (including legal fees) arising from your misuse of the App, your Input or Output, or your breach of these Terms or of any law or third-party right.
These Terms apply until terminated. Your licence ends automatically if you breach them; you may end it by deleting the App. Sections that by their nature should survive (including Sections 2, 5, 10, 11, 13 and 15) survive termination.
These Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict-of-law rules, and the courts located there have non-exclusive jurisdiction over disputes. This does not deprive you of any mandatory consumer-protection rights, or of the right to bring proceedings in the courts, of your country of residence where applicable law so requires.
If any provision is held unenforceable, the remaining provisions stay in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms; we may assign them in connection with a transfer of the App. These Terms, together with the Apple Standard EULA and our Privacy Policy, are the entire agreement between you and us regarding the App.
We may update these Terms from time to time. The "Last updated" date shows the latest version, and material changes will be reflected in the App or on this page. Your continued use of the App after changes take effect constitutes acceptance.
